OFFICIAL RULES FOR ORIGINAL HARP SWEEPSTAKES NO PURCHASE IS NECESSARY TO ENTER THE SWEEPSTAKES
OPEN TO U.S. RESIDENTS ONLY
The Original Harp Sweepstakes (the “Sweepstakes”) is sponsored by HOHNER Musikinstrumente GmbH (referred to in these Official Rules as the “Sponsor”). The principal place of business of HOHNER Musikinstrumente GmbH is Andreas-Koch-Str. 9, 78647 Trossingen, Germany. The Sponsor can be located at its principal place of business.
The Sweepstakes is offered only to persons 21 years of age or older legally residing in the fifty United States and the District of Columbia. Residents from elsewhere are ineligible. Void outside of U.S., in Puerto Rico and all U.S. territories and possessions and where prohibited or restricted by law.
Employees of the Sponsor and the Sponsor’s affiliates, the immediate families of such employees (employees’ parents, siblings, children and spouses) and members of the same household of such employees are not eligible to enter the Sweepstakes.
HOW TO ENTER
During the Sweepstakes Period (defined below), you may enter the Sweepstakes in the following ways: (1) Purchase a Hohner 10 hole Diatonic Harmonica and visit HohnerOriginals.com and complete the online entry form by entering the Free Online Lesson code and providing a valid email address.; or (2) hand print your name, complete address and phone number on either a 3 1/2" x5 postcard, separate piece of paper no larger than 8 1/2' x 11", or download the no purchase necessary coupon from hohneroriginals.com and mail the card, paper or coupon to The Original Harp, C/O Hohner, KHS America, Inc. 12020 Eastgate Boulevard, Mt Juliet, TN 37122. All information provided during entry must be complete, truthful, and accurate.
Limit one (1) entry per entrant and e-mail address for the Sweepstakes Period (defined below), regardless of entry method. If it is discovered or suspected, in Sponsor’s sole discretion, that an entrant has submitted entries using multiple e-mail addresses or identities, all of that entrant’s entries may be declared null and void and any prize he or she might have been entitled to will not be awarded to him/her. Use of any automated system to participate in the Sweepstakes is prohibited and will result in disqualification of any entrant attempting such use.
No correspondence or contact other than that specified in these Official Rules will be accepted as an entry in the Sweepstakes. All entry information becomes the property of the Sponsor and will not be returned.
HOW THE SWEEPSTAKES WORKS/PRIZE AND PRIZE WINNERS SELECTION
All persons who completely satisfy the entry conditions set forth above and become Entrants will be eligible to win a Set of Hand Signed Harmonicas in Display Case (approximate retail value: $550.00). The odds of winning any prize depends on the number of valid entries received. One (1) Entrant, randomly drawn from all entries received during the Sweepstakes Period, will be awarded the prize specified by the Sponsor as being awarded, approximately  days after the Sweepstakes Period. Only one (1) Set of Hand Signed Harmonicas in Display Case will be awarded during the Sweepstakes. No purchase is necessary to enter the Sweepstakes or to be awarded a prize. The Sponsor shall announce the verified winner of the Sweepstakes Prize by March 1, 2019. The Sponsor reserves the right to announce the identity of the Sweepstakes prize winner and the prize awarded to each such winner on any of its websites or those of its affiliates.
The prize winner will be required to execute and return a Declaration of Eligibility and Liability Release. The potential winner must return a fully executed all requested documents to the Sponsor or its authorized designee within seven (7) calendar days from the date it is postmarked as being sent or the prize may (in Sponsor’s sole discretion) be forfeited and awarded to an alternate winner. Except where prohibited by law, acceptance of a prize shall constitute and signify the winner's consent that the Sponsor may use the winner's name, likeness, image, voice, photographs, biographical information, address (city and state) and written statements made by the winner about the Sweepstakes and Sponsor for promotional purposes, in all forms of media, in perpetuity and without monetary payment or consideration.
Delivery must be made to winner’s residential address in the 50 United States or the District of Columbia. Sponsor will not deliver the prize to any other address.
If a prize notification e-mail or regular mail notification is returned or deemed undeliverable, or if the winner is found to be ineligible or fails to comply with these Official Rules, the Sponsor may decide, in its discretion, that the winner has forfeited the prize and an alternate winner of that prize will be selected from eligible Entrants.
The Sweepstakes begins on October 1, 2018 and ends on January 31, 2019 (the “Sweepstakes Period”). All entries must be received by the Sponsor or postmarked by 11:59 PM Central Standard Time on the last day of the Sweepstakes Period. If an entry form is postmarked within the Sweepstakes Period but not received within three days of the close of the Sweepstakes Period for any reason, it shall be ineligible. Approximately ten (10) days after the Sweepstakes Period, one Entrant will be randomly selected for award of the prize.
ODDS OF WINNING
The odds of winning any prize depends on the number of valid entries received. The purchase of any goods or services from the Sponsor or its affiliates will not improve the odds of winning.
The prize is non-transferable and is not exchangeable for cash. The prize winner will be solely responsible for all taxes (federal, state and/or local) and any expenses not specified related to acceptance and use of the prize. Sponsor reserves the right to substitute a prize of equal or greater value for any reason.
The Sponsor is not responsible for errors, omissions, interruptions, deletions, defects, delays in operations or transmissions, theft or destruction or unauthorized access to or alterations of entry materials, or for technical, network, telephone, computer, hardware or software malfunctions of any kind, or inaccurate transmissions of, or failure of the Sponsor to receive entry information on account of human or technical problems in any combination thereof. Sponsor reserves the right, in its sole discretion, to modify or terminate the Sweepstakes in the event of any act, occurrence, or reason that it believes would corrupt the integrity, administration, or fairness of the Sweepstakes. The Sweepstakes is subject to these Official Rules. By entering, (a) participants agree to these Official Rules, the decisions of the Sponsor, which shall be final and binding in all respects, and waive any right to claim ambiguity in the Sweepstakes or these Official Rules; (b) participants release the Sponsor, its directors, officers, employees, affiliates, agents, representatives, vendors and such persons’ directors, officers, employees and agents from any and all liability for any claims, injuries, losses, costs or damages of any kind caused by participation in the Sweepstakes or resulting from acceptance, possession, use or misuse of the prize; and (c) PARTICIPANTS ACKNOWLEDGE THAT THE SPONSOR AND OTHER RELEASED ENTITIES AND INDIVIDUALS HAVE NEITHER MADE, NOR ARE IN ANY MANNER RESPONSIBLE OR LIABLE FOR ANY WARRANTY, REPRESENTATION, OR GUARANTEE, EXPRESSED OR IMPLIED, IN FACT OR IN LAW, RELATIVE TO THE PRIZE, INCLUDING BUT NOT LIMITED TO THEIR QUALITY, MECHANICAL CONDITION, AUTHENTICITY OF AUTOGRAPHS, OR FITNESS, EXCEPT FOR ANY STANDARD LIMITED WARRANTY OFFERED BY ANY MANUFACTURER OF THE NON-CASH PRIZE. The Sponsor may prohibit an Entrant from participating in the Sweepstakes or winning any prize if, in its sole discretion, it determines that the Entrant is attempting to undermine the legitimate operation of the Sweepstakes by cheating, hacking, deception, or other unfair practices or intending to annoy, abuse, threaten or harass any other participants or the Sponsor’s agents or representatives. The Official Rules have not been authorized, issued or approved by any court, official, agency of the United States or any state or by any lawyer, law firm or insurance brokerage company.
WARNING: ANY ATTEMPT BY A PARTICIPANT TO DELIBERATELY UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING ATTORNEYS’ FEES) FROM ANY SUCH PARTICIPANT TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION.

By completing the Sweepstakes Registration forms, Entrants grant the Sponsor the right to use the information provided on the forms, and to contact the Entrant by e-mail, telephone, mail, certified mail or fax, including for commercial and marketing purposes.

You can contact our data protection officer at email@example.com. HOHNER is controller in the sense of the EU General Data Protection Regulation (GDPR).
These data protection rules apply if you enter the Original Harp Sweepstakes. When you visit our homepage or otherwise interact with us, please find additional information on our data processing in our general data protection regulation.
HOW WE USE YOUR PERSONAL DATA
In order to carry out the Sweepstakes, we use your personal data. We may store and use your personal data (such as your e-mail address and, where applicable, name, place of residence and postal address or other information necessary for the Sweepstakes), for the duration of the Sweepstakes. We process your personal data in order to draw the prize winner. The data processing is necessary to conduct the Sweepstakes. It is lawful according to Art. 6 Para. 1 b) GDPR. Your personal data will be deleted after the Sweepstakes has terminated, unless you have signed in to our newsletter and thus agreed in the further processing.
If you have entered the Original Harp Sweepstakes by sending a written letter or postcard to our U.S. distribution partner KHS Americas, Inc., KHS Americas, Inc. will store and forward us your personal data. This transmission is necessary so we can draw the winner. This data processing is lawful according to Art. 6 Para. 1 b) GDPR. Your personal data will be deleted after the Sweepstakes has terminated.
We will forward the winner´s personal data, e.g. name and postal address, to our U.S. distribution partner KHS Americas, Inc. This transmission is necessary so that we can deliver the prize. It is lawful according to Art. 6 Para. 1 b) GDPR.
We will use the winner´s name, likeness, image, voice, photographs, biographical information, address (city and state) and written statements made by the winner about the Sweepstakes and HOHNER for promotional purposes, in all forms of media. We will do this in order to carry out the Sweepstakes. This data processing is lawful under Art. 6 Para. 1 b) GDPR.
You have the right to ask the data controller to confirm whether personal data concerning you are being processed; if this is the case, you have a right of access to this personal data and to the information specified in Article 15 of the GDPR. In accordance with Article 15 Para. 3 of the GPDS, you have the right to obtain from the data controller a copy of the personal data which are the subject of the processing.
According to Article 16 of the GDPR, you have the right to request the data controller to correct incorrect personal data concerning you without undue delay and to complete incomplete personal data.
You have the right to request the data controller to erase personal data concerning you without undue delay, provided that one of the reasons specified in Art. 17 GDPR applies. You have the right to require the controller to restrict processing if one of the conditions set out in Article 18 GDPR is met.
You have the right to receive the personal data concerning you from the data controller in a format outlined in Article 20 GDPR.
You have the right to object at any time, for reasons relating to your particular situation, to the processing of personal data concerning you under Article 6 Para. 1 (f) GDPR, pursuant to Article 21 GDPR.
If you have given your consent to the processing of your data, you can withdraw this at any time. A withdrawal will not affect the lawfulness of processing based on consent before its withdrawal.
Without prejudice to any other administrative or judicial remedy under Article 77 of the GDPR, you have the right of appeal to a supervisory authority, in particular in the Member State where you are staying, working or suspected of having infringed the GDPR, if you believe that the processing of personal data concerning you is contrary to it. In the German Federal State of Baden-Württemberg, the responsible supervisory authority is the State Commissioner for Data Protection and Freedom of Information, P.O. Box 10 29 32, 70025 Stuttgart.
